Branmark Advocates successfully represented the mortgagors in this suit in the Uganda Court of Appeal against ABSA Bank Uganda Limited (formerly, Barclays Bank of Uganda Limited). In the Judgement, the Mortgagors were awarded Uganda Shillings five billion, two hundred million (USSD 1,403,587.19), UgShs. Two hundred million in General damages (USD 53,984.12), Ugshs Fifty million (USD 13,496.03) in Exemplary damages all with interest. Other orders included setting aside the Sale & transfer of the Mortgage Property, Cancellation of Purchaser’s Title & re-instatement of Mortgagor as the lawful owner of the pledged properties, and Vacant possession was awarded to the Mortgagor.
